Privacy Notice – KnowYourAgent.run

KnowYourAgent.run (“KnowYourAgent,” “we,” “us,” or “our”) is a service provider that assists energy service companies (“ESCOs”) and other authorized sales organizations in verifying that only properly credentialed sales agents are permitted to actively sell. This verification process is designed not only to protect ESCOs and consumers, but also to protect legitimate sales agents by helping prevent commissions or sales credit from being fraudulently attributed to another individual.

This Privacy Notice describes how KnowYourAgent collects, uses, retains, and protects information relating to sales agents who are onboarded or credentialed through the KnowYourAgent platform.

Information We Collect

As part of the agent credentialing and verification process, KnowYourAgent may collect the following categories of information:

• A badge photograph or selfie provided by the sales agent for identity verification purposes.

• A short audio recording or sound bite that may be used to generate a voiceprint.

• Certain digital markers associated with the sales agent’s mobile device, such as device identifiers, operating system characteristics, or similar technical signals.

These data elements are collected solely for the purpose of agent identification, authentication, and fraud prevention.

Use and Processing of Information

Where applicable, the information collected is processed, transformed, and reduced into encrypted or hashed values. These derived values are used exclusively to support identity matching, agent presence verification, and detection of unauthorized or impersonated agent activity. The information is not used for marketing, profiling, advertising, or any purpose unrelated to agent verification.

KnowYourAgent does not attempt to determine personal traits, behaviors, or characteristics beyond what is necessary to confirm that the same credentialed agent is consistently participating in sales activity.

Information Sharing and Disclosure

KnowYourAgent does not sell personal information and does not share personal information with unaffiliated third parties for commercial purposes.

Information may be disclosed only in the following limited circumstances:

• To the applicable ESCO or authorized sales organization on whose behalf the agent is selling, solely for credentialing, compliance, and verification purposes.

• To reputable cloud and technology service providers, such as Microsoft, Amazon Web Services (AWS), or Google, that may be used to support secure storage, processing, or analysis of selfies, voiceprints, or device digital markers. These providers act as service providers and are contractually obligated to protect the data and use it only as instructed.

• When required to do so by applicable law, regulation, legal process, or lawful governmental request.

Data Retention and Destruction

All data collected by KnowYourAgent is retained only for as long as necessary to fulfill the verification and compliance purposes described in this notice.

Following an agent’s termination from the applicable sales channel, associated data is archived for a period of twelve (12) months and is then permanently destroyed in accordance with KnowYourAgent’s data destruction policies.

Earlier data destruction requests may be submitted by the agent by contacting privacy@knowyouragent.run. Requests will be evaluated in accordance with contractual, legal, and regulatory obligations.

Data Security

KnowYourAgent employs administrative, technical, and organizational safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction. These safeguards include encryption, access controls, and secure processing environments.

Purpose Limitation

The sole purpose of collecting and processing information through KnowYourAgent is to assist ESCOs and authorized sales organizations in confirming that sales activity is conducted only by properly credentialed agents, and to protect legitimate agents from fraud, impersonation, and misattribution of sales or commissions.
